    Press Release:

As DOJ investigates Clinton, conflicts of interest and appearance of favoritism mount

Raleigh, N.C.     The North Carolina Republican Party (NCGOP) today called on President Obama to stop campaigning with Hillary Clinton due to his administration's investigation into her reckless email practices. Just days after Hillary Clinton was interrogated by the FBI, President Obama hit the campaign trail with Clinton, stopping in Charlotte this afternoon. This, bringing attention to the massive conflict of interest and appearance of favoritism towards Clinton.

"How can the President of the United States campaign with someone his own administration is investigating," questioned NCGOP Chairman Robin Hayes. "President Obama and Joe Biden should cancel further campaign stops with Clinton to avoid any more appearance of favoritism towards her, especially after Bill Clinton's sketchy meeting with Attorney General Loretta Lynch. North Carolina voters are going to have a hard time believing this investigation is actually independent. How could they not?"

Former Rockingham County District Attorney, Judge Phil Berger Jr. added that the appearance of favoritism threatens the public's confidence in the administration's ability to remain impartial should there be definitive proof that Hillary Clinton broke the law.

"It is important that no one appears to be above the law. North Carolinians and the American public should never have to question whether the Attorney General is capable of exercising independent and unbiased judgment. Every effort should be made to avoid conflicts of interest and certainly, past and current Presidents of the United States should do everything in their power to do just that. Arranging secret meetings on tarmacs and campaigning with subjects under investigation hardly meets that standard," said Judge Phil Berger Jr.

Background:

Hillary Clinton Was Interviewed By The FBI Saturday Morning In Connection With Her Use Of A Secret Server As Secretary Of State. "An aide said the interview occurred at FBI headquarters in Washington Saturday morning and lasted approximately three and a half hours. The FBI declined to comment on the interview. The meeting means the investigation into Clinton's use of a private email server for official business as secretary of state is coming to an end. The question now becomes how long it will take for the FBI to conclude its probe." (Dan Berman, "Clinton Questioned By FBI As Part Of Email Probe" CNN, 7/2/16)

Of The Clinton Emails That The State Department Released, There Were 2,101 Emails Containing Material That Was Classified. "According to information released Monday by the State Department, Clinton's emails totaled 52,402 pages and included 2,101 emails that had been redacted in all or part because they contained material that was deemed classified." (Rosalind S. Helderman, "State Department Release Final Batch Of Clinton Emails," The Washington Post, 2/29/16)

  • A Full 22 Emails Deemed "Top Secret," Are Being "Withheld In Full" And Will Never Be Released To The Public Due To Their Classified Nature. "A second source not authorized to speak on the record said the number of accounts involved could be as high as 30 and reflects how the intelligence was broadly shared, replied to, and copied to individuals using the unsecured server. The State Department recently confirmed that the messages in question include the most sensitive kind of intelligence. On Jan. 29, Fox News first reported that some emails on Clinton's server were too damaging to release in any form. The State Department subsequently announced that 22 'top secret' emails were being withheld in full; these were the messages being handled by more than a dozen accounts." (Catherine Herridge And Pamela Browne, "Official: Top Clinton Aides Also Handled 'Top Secret' Intel On Server," Fox News, 2/10/16)

Hillary Clinton Signed A Non-Disclosure Agreement That Stated She Knew Classified Information Could Be Marked Or Unmarked. (Hillary Clinton, Classified Information Non-Disclosure Agreement, 1/22/09, State Department Release, FOIA # F-2015-05069, 11/5/15)

The Same NDA That Clinton Signed Said It Was A Violation Of US Law To Retain Any Classified Information. (Hillary Clinton, Classified Information Non-Disclosure Agreement, 1/22/09, State Department Release, FOIA # F-2015-05069, 11/5/15)
