Public Notice of Filing Extension after death of Candidate | Eastern North Carolina Now

News Release:

    The Beaufort County Board of Elections was notified on Tuesday, August 13th, of the passing of Commissioner and Candidate Don Wilkinson of the Town of Washington Park. § 163-294.4 (b) dictates that if the number of candidates falls below the number of seats open for election, then the Board is to reopening a filing period for that particular contest. In this case, four candidates remain with five seats open.

    The Beaufort County Board of Elections will reopen the filing period for the contest of Commissioner for the Town of Washington Park starting at 8:00 am on Monday, August 19th, 2013 and will close the filing period at 5:00 pm on Friday, August 23rd, 2013. This is only for Washington Park Commissioner and does not include the office of Mayor or any other contests in any other municipalities in Beafuort County.

General Statute language that clarifies procedure for the Beaufort County Board of Elections here below:


(b) If at the time the filing period closes only two persons have filed notice of candidacy for election to a single office or only as many persons have filed notices of candidacy for group offices as there are offices to be filled, and thereafter one of the candidates dies before the election and before the ballots are printed, the board of elections shall, upon notification of the death, immediately reopen the filing period for an additional five days during which time additional candidates shall be permitted to file for election. If the ballots have been printed at the time the board of elections receives notice of the candidate's death, the board shall determine whether there will be sufficient time to reprint them before the election if the filing period is reopened for three days. If the board determines that there will be sufficient time to reprint the ballots, it shall reopen the filing period for three days to allow other candidates to file for election.
