SCOTUS failed America on Alien Enemies Act ruling

In an excellent editorial, the Washington Times has blasted the Roberts-led US Supreme Court for placating the left by waffling on illegal immigration issues.  In particular, it criticized the court's ruling on the Alien Enemies Act.  That ruling is wholly inconsistent with court precedent on the same act set in 1948.

This follows Fifth Circuit Court of Appeals Judge James Ho's remarkable takedown of the Supreme Court on the same case dealing with the Tren de Aragua and the Alien Enemies Act in which he scathingly wrote in criticism of the SCOTUS: "we should admit that this is special treatment being afforded to certain favored litigants like the members of Tren de Aragua - and we should stop pretending that Lady Justice is blindfolded."

Polls consistently show that an overwhelming majority of Americans want these illegal alien invaders expelled from our country.  Our elected officials are working hard to carry out this desire of our citizens.  When our courts resist, they are thwarting democracy.  When they abandon established precedent to thwart deportation they are also thwarting the Rule of Law.

Meanwhile, Secretary of State Marco Rubio has denounced a corrupt Biden judge for interfering in American foreign policy by disrupting the deportation of illegal alien criminals to South Sudan.  He said that abuse of power by the Biden judge has interfered with American diplomacy with South Sudan and other countries in the region.

One of the problems in the federal district courts is that 2/3rds of the judges are leftwing Obama or Biden judges who play partisan politics from the bench..

Roberts is awful, but he will only go down as second worst. Eisenhower's appointee as Chief Justice, Earl Warren, was even worse. Oddly, the two most dependable justices, Alito and Thomas were Bush appointees. The three Trump appointees, Gorsuch, Kavanaugh, and especially Barrett, are all over the landscape. The Trump team was concentrating on the issue of overturning Roe v. Wade, when they should have been looking at a fuller range of issues.

Borderhawk: Roberts is compromised, and will go down in history as one the worst Republican appointees of all time.

Republican Presidents need to vet their appointments far more stringent Democratic Socialist senators, or the Democratic Socialist Propagandistic Media, when making appointments.

The Non Patriot Left will employ whatever necessary to destroy this Constitutional Republic.

I have a quick and easy, well considered approach to the Democratic Socialists' cry for their faux "due process:" Either treat these Illegals as Illegal Aliens, with their immediate "due process" deportation; or, give the Illegals their Non Patriot Left ordered "due process," and then indict, prosecute, and punish the entire Biden Administration responsible for aiding and abetting, as treasonous traitors, for this open facing, premeditated invasion of our borders in federal criminal court.

Then go to the civil courts after certain victory, and sue to take everything of value from these treasonous traitors, their families and other, be they Democrat, "Republican," or politically Independent co-conspirators to help pay for this immense ongoing cost to our innocent American People.

For some of the lead conspirators that sought to damage and defraud the United States of America for profit, be it political or otherwise, life in prison and, or the death penalty would NOT be off the prosecutorial table.

It is truly a fair tradeoff: Due process for Illegals as a trade for Due Process for the seriously damaged American People.

Smart, wise justice is what this Constitutional Republic deserves, and it deserves it NOW.

The Democrat gambit on deportation of "due process" is totally bogus. It is a scam to try to delay the process and keep the illegal aliens in the US. Many of them have already had their due process in the immigration courts where they received "removal" orders. There is no basis for the district courts to get involved.

For example Democrat MS13 poster boy Kitmar Allbrego Garcia had his day in court in the immigration court, which ruled he was a member of MS13, in the country illegally, and subject to removal. He appealed to an appellant immigration court which affirmed the findings and rulings of the immigration trial court. Boasberg and other OBama and Biden judges have absolutely no business fooling around in his or other immigration cases. There are separate federal courts for that.

Obama and Clinton each deported hundreds of thousands of illegal aliens without politically motivated district court judges sticking their noses into those deportations. That was also true in the last mass deportation, President Eisenhower's Operation Wetback. The Trump administration is being treated differently for purely political reasons and our federal courts should be ashamed of playing politics that way. They are destroying their own credibility with the public by what they are doing.

Chief Justice Roberts disgusting way of trying to play to the MSM media is also doing a lot of damage to the reputation of his court, something he ought to think about.

Circuit Judge Ho's rebuke to the Supreme Court over that Tren de Aragua case was priceless and something that is not often seen. Maybe he should be nicknamed "Judge Big Balls". He should also be on Trump's short list the next time a Supreme Court vacancy comes up.

That cartoon from the Washington Times is also rather telling, with the scales of justice balancing a judge's gavel on one side and a skull with migrant gang tattoos and a Venezuelan flag on its forehead on the other. Two thirds of district judges are Democrat appointees often chosen for ideological and partisan political reasons, but one would expect the SCOTUS to be more attuned to following precedent like Ludecke v. Watkins, the 1948 Supreme Court case which upheld the Alien Enemies Act.
