Governor McCrory signs legislation protecting employer and claimant confidential information | Eastern NC Now

    Raleigh, NC — Governor Pat McCrory signed Senate Bill 42 into law today. This legislation ensures the Division of Employment Security (DES) is in compliance with the U.S. Department of Labor (USDOL). The legislation has also made certain that DES is statutorily prohibited from selling and releasing confidential appeals hearing notices.

    "The passage of this bill ensures that DES is able to fully protect its employers' and claimants' confidential information," said Governor McCrory. "I'd like to thank DES Assistant Secretary of Commerce Dale Folwell for his leadership on the issue and commend the strong team he has put together."

    Earlier this year, DES decided to change a decade-old practice of providing daily copies of appeals hearing notices, which included sensitive claimant and employer information and reasons why the person is no longer employed. In response, one of the attorneys obtained a temporary restraining order and sued DES which resulted in a Preliminary Injunction in Superior Court prohibiting DES from discontinuing the practice. In several letters, USDOL demanded DES cease sending out these notices.
