I downloaded five years of H-1B data from the US DOL website (4M+ records) and spent the day crunching data.

I went into this with an open mind, but, to be honest, I'm now *extremely* skeptical of how this program works.

The program has a statutory limit of 85,000 visas per year, but employers routinely receive approval for more than 800k applications per year (868k, or 10x the limit, in 2024).

President Trump made very significant reforms in the H-1B visa program in 2020 to clean it up and end the abuse. A few months later, however, on his first day in office, Joe Biden wiped out all of those refotms. Biden then started allowing things that made the abuses even worse. While we need these visas to continue in line with what they were origianlly intended to be, President Trump now has an even bigger mess to clean up with these visas than he did in 2020.

One of the leading organizations fighting against illegal immigration, the Federation for American Immigration Reform (F.A.I.R.) had a thoughtful proposal for reforming the problematic H-1B visa program long before the current storm broke, including both ideas that President Trump implemented in 2020 and some new additions to prevent the current abuse.

One can sort of sympathize with Musk's emotional reaction since it has come out that when Musk himself first came to America, it was on an H-1B visa.

The Indians have earned little sympathy in Congress because nearly all of them were imported by investors and their executives to take career-starting, mid-skill white-collar jobs that would otherwise have gone to young U.S. professionals.
The Indians are allowed to take desirable careers from Americans because many U.S. employers use the H-1B, L-1, J-1, TN, OPT, CPT, and H4EAD programs to hire low-wage foreign graduates, mostly for entry-level jobs. Indians get roughly 70 percent of these visas.

These programs are uncapped, do not require the jobs be offered to Americans, and do not require a skills test. Only the uncapped O-1 “genius visa” requires proof of prior accomplishment.
Those numbers suggest that at least 600,000 Indian H-1B workers now hold white-collar jobs needed by American graduates. More than 500,000 other Indians hold jobs via other visa programs.
This inflow is cheered on by executives who can convert every $1 in payroll savings into $20 of additional stock value.

There he goes again. Bigot Bob tries to bring race into everything, and it is usually not appropriate like here. The big abusers of the H-1B visas are the crooked woke corporations like Disney. Those abuses do need to be dealt with.

H-1B visas are temporary non-immigrant work visas that do not give a path to citizenship. They require a high level of skill. The concept behind the program is good but it has been badly abused in recent years. This is a program that needs to stay but be reformed to eliminate the abuse of it. They are not supposed to be used to replace American workers but cynical companies have used them for just that purpose, and Disney is an example. One reform that would improve the program is to add a very high penalty for any company found to be eliminating jobs for American workers and replacing them with H-1B foreign workers. H-1B is supposed to be a supplement when American workers are not available and that purpose should be enforced.
