US Circuit judge blasts SCOTUS on illegal alien due process ruling | Eastern NC Now

When the US Supreme Court ruled that illegal aliens had to have some due process in deportations under the Alien Enemies Act, in effect reversing a 1948 SCOTUS ruling which said courts were not even allowed to hold hearings on such deportations,, and returned the case to the 5th Circuit, they probably did not expect the pushback they got from an outraged 5th Circuit Appeals Court judge.

Circuit Court of Appeals Judge James Ho in a written opinion first acknowledged that he had no choice but to obey the Supreme Court, but then proceeded to barbecue the SCOTUS on its ruling, stating "I write to state my sincere concerns about how the district judge as well as the President and other officials have been treated [by the SCOTUS] in this case. I worry that the disrespect they have been shown will not inspire continued respect for the judiciary, without which we cannot long function."

Judge Ho noted that the plaintiffs had demanded an answer from the District Court judge on a restraining order after hours in 42 minutes or they would take an emergency appeal.  Judge Ho was appalled at the Supreme Court tolerating such behavior, noted "This is a district court, not a Denny's"

Judge Ho summed up "we should admit that this is special treatment being afforded to certain favored litigants like members of Tren de Aragua - and we should stop pretending that Lady Justice is blindfolded."

When a vacancy on the SCOTUS comes up, Judge James Ho is one who should be considered for it so he can address his wisdom to the faces of some of the weaels now on the court.
