Spain's top court rules Covid lockdowns were unconstitutional | Eastern NC Now

where are US courts on issue?

ENCNow

Spain's top court has unanimously ruled that the Covid lockdown order imposed by the country" Socialist government was unconstitutional in that it denied the basic rights of citizens.  The ruling by the Constitutional Court came in a lawsuit filed by the populist / nationalist right Vox Party.

The lockdown was wildly unpopular in Spain, and had led to massive public demonstrations against it that turned violent.  While the government had already ended the lockdown, this court ruling will now allow citizens who lost money due to the lockdown to sue the government for damages.

Some American courts, notably the Michigan Supreme Court have struck down governor's lockdown orders or parts of them, but they have usually based their rulings on governors exceeding their statutory powers. US appellate courts have generally shied away from asserting the fundamental Constitutional rights of citizens to the extent that the Spanish court has.
