NC Federal Judge cites 'disinformation' to ratify State censorship | Eastern NC Now

Judges steps all over the Constitution

ENCNow

"From U.S. District Judge Thomas Schroeder — a Republican president George W. Bush appointee.  So we are yet again reminded that awful government is, as always, bipartisan.

Judge Schroeder’s ridiculous ruling ratifies North Carolina’s state government censorship law.  And it does it in the name of stamping out “disinformation.”

And here’s the really ironic part:  North Carolina’s censorious law is predicated upon actual disinformation.  Isn’t this fun?

Except a “patent troll” is a fake thing.  Made up by people who want to steal patents.

“(W)hat exactly is a ‘patent troll?’  He or she is someone who owns a patent – which is private property. And is trying to protect their private property from unauthorized use by someone who doesn’t want to pay to use it.

Unfortunately, the North Carolina state government apparatus fell for the “patent troll” lie.  Or further spread it — to aid patent-stealing, political-contributing-cronies.

By passing a law that purports to deal with this fake creature.

“A North Carolina federal court…(ruled) the North Carolina Abusive Patent Assertions Act (APAA) doesn’t violate the First Amendment of the U.S. Constitution….”

Of COURSE the law violates the First Amendment.  It is government censoring the speech of patent holders.

This law — and the ruling upholding it — eviscerates the system by which patent holders can protect their patents.  It smothers in the crib any attempt by a patent holder to stop people from stealing it.
