Garland still facing contempt of Congress arrest over Biden tapes | Eastern NC Now
rarely used procedure can go around Garland refusing to prosecute himself
Congresswoman Anna Paulina Luna (R-FL) declared at a press conference today that Attorney General Merrick Garland had until Friday to turn over to Congress the Biden tapes subpoenaed by Congress. If he fails to do so, she intends to trigger a little used power of Congress called Inherent Contempt of Congress, under which Congress can order the House Sergeant at Arms to take Garland into custody for prosecution.
Inherent Contempt of Congress was first used in 1795 and was approved by the US Supreme Court in a case in 1927. It was last used by Democrats during the Trump administration when they threatened Attorney General Bill Barr with it if he did not turn over to Congress an unredacted copy of the Special Counsel report on the Russiagate investigation. Barr turned it over.
Congresswoman Luna told Garland that he was not above the law.
