Comments for NYC Good Samaratan Penny under prosecution by crooked Soros prosecutor Bragg | Eastern NC Now

Having spent decades practicing criminal law, it is clear to me that this was a textbook case of both self defense and even more so defense of others. Alan Dershowitz, a very renowned legal expert, is absolute correct that this case never should have been brought against Penny. The testimony of the other passengers, many of them minorities and including children and the elderly, that they were in fear of their lives from Jordan Neely was clear cut. ONe elderly black woman at the end of her testimony turned to Penny and said "Thank you". Neely made the explicite threat in so many words to kill the passengers and began acting aggressively toward them. Penny was fully justified under the doctrine of defense of others as well as self defense to neutralize the threat. Since Neely was breathing on his own and had a heartbeat when help arrived it is a real stretch to say Penny "killed him".

Those of the left these days want the rights of self defense and defense of others to go away, but they are critical to our system of justice.

Alan Dershowitz, the renowned Harvard Law Professor emeritus was on the radio today, pointed out the Jordan was alive, breathing and heartbeat, when paramedics arrived, that Penny had a solid self defense / defense of others situation, that Penny should have never been charged, and that Alvin Bragg is the worst DA in New York history. Dershowitz is a life long Democrat who voted for Biden in 2020.

I think Alan Dershowitz is a more credible source on how the law applies to these facts than leftwing internet troll Bobbie. That means that Bobbie's contentions are untrue, as usual.

Bobbie, you only post one side, that of the far left, so I have my doubts you see both sides of much of anything. What happened on that subway car may be propagandized as "murder" by the BLM and others of their far left ilk, but it clearly was anything but. The attacker came into the subway car, menacingly threatened to kill everyone there and himself and started angrily getting in people's faces. Daniel Penny was a hero who rose to the defense of the potential victims of the attacker and used an appropriate level of force to defend himself and the others from this threat. The rescue squad found the attacker breathing and with a heartbeat after Penny released him.

I celebrate a hero who intervened to prevent murders by a deranged attacker.

If you are on the New York subway, you should pray there is someone like Penny on your subway car, and NOT someone like the deranged attacker.

In Manhattan there have recently been two subway heros who intervened to stop an attacker threatening death to riders. One was black and one was white. The attacker died in both cases, one from a gunshot wound inflicted during the incident and the other AFTER the incident as he was still breathing and had a heartbeat when the rescue squad arrived. The heroes involved were treated in very different ways solely based upon their race by this evil Soros DA, which Bigot Bob approves of.

So Alvin Bragg is not a racist when he takes out no charges at all on a black subway hero who gets a gun away from a black attacker and then fatally shoots him with the gun he has taken away, but then throws the book at a white subway hero who subdues a black subway attacker with his bare hands, leaving the attacker breathing and with a heartbeat when paramedics arrived? That is a clear racial double standard. It makes Bragg a racist, and it makes Bigot Bob a racist for supporting him in it.

In Alvin Bragg's corrupt prosecutorial system, it is best to be black and poor. A good example is the black criminal with a long criminal record who shot and killed an elderly Asian man in an armed robbery. The same rabid leftist assistant district attorney who is handling the Penny prosecution gave him a sweetheart plea deal with a slap on the wrist in what she terms "restorative justice".

America deserves better than these corrupt, racist, and pro-criminal Soros prosecutors. It is a good thing that two dozen of them have been removed from office in the last two years. Alvin Bragg needs to go.

For centuries in Anglo-Saxon criminal law, a right of self defense and a right of defense of others have been recognized. Both of these applied to Daniel Penny and it is a horrible miscarriage of justice that he was charged over this incident. That is particularly true since the psycho who attacked the passengers was breathing and had a heartbeat when the rescue squad arrived.

This is racial politics by Alvin Bragg. There was a very similar case in Manhattan not long before where a black man armed with a gun threatened a car load of subway riders. Another black man acted the Good Samaratan then, got the gun away from the attacker and shot him dead with it. He was not charged with anything.

There is clearly a racial double standard of "justice" in Manhattan courts, just as there is a two tier justice system there based on politics.

That medal proposed for Penny is the highest honor that can be given by the United States to a civilian. I wish Congress had gotten moving on that earlier. He deserves it for protecting those people on the subway car.

The federal government can do something even stronger than cutting off funding to crack down on the pro-crime liberal prosecutors who indict heroes like Daniel Penny. There is a federal criminal felony statute for violating a citizen's civil rights. Alvin Bragg should be indicted under that statute from his prosecution of Penny. Send Bragg to federal prison.
