Mistrial for AZ rancher charged with shooting an illegal alien on his ranch | Eastern NC Now

only one holdout against acquital

ENCNow

The jury trying a 76 year old Arizona rancher for shooting an illegal alien on his border ranch has voted 7 tp 1 for acquittal, and the only juror wanting a conviction would not budge, so the judge has declared a mistrial.  Arizona conducts criminal trials with a jury of 8, instead of 12.

Rancher George Kelly was out on his ranch when he spotted a group of illegal alien males dressed in camoflage and one of the illegal aliens pointed an AK-47 at him.  Kelly grabbed his own AK-47 and fired several warning shots at the illegal aliens and then left as he was outnumbered.  Kelly later returned and found a dead illegal alien at the scene.  The illegal alien was identified as one who had been deported previously many times and was thought to be a cartel smuggler.
