federal judge suspends Biden "universal background check" gun rule

In a lawsuit filed by Gun Owners of America (GOA) and the State of Texas, a federal District Court judge has issued a temporary restraining order suspending any enforcement of Biden's new "universal background check" executive rule. The rule rewrites Congressional legislation without consulting Congress to require background checks on private gun sales and transfers. Federal law as passed by Congress only requires background checks on gun sales by licensed firearm dealers. The TRO will stop enforcement of the rule until the Court can hear the case and consider the law and the evidence.

GOA has been replacing the NRA as the most effective and proactive gun rights group in America. They often take stronger positions to protect gun rights than the NRA.

This rule is yet another Biden attempt to do an end run around Congress and change the law by executive fiat. In doing so, he goes against the longstanding doctrine of Separation of Powers, a cornerstone of our democracy and our rights. Under that doctrine, it is Congress that makes the laws, and the executive branch is supposed to enforce the laws passed by Congress, not rewrite them.

Those with a felony conviction and other criminals are not likely to be getting a gun from a family member or neighbor. They are going to other criminals like at the open air drug markets. This rule is targeted at John Q. Public who gives a gun to a family member or sells one to a friend, but is not a gun dealer.

Gun dealers are well educated on how this law works and how to comply. John Q. Public may not even know they are covered, and even if they know that, they probably do know know how to comply. This rule is designed to trip up law abiding citizens and will not have any effect on criminals having guns.

Most importantly, in a democracy, it is the legislative branch, NOT the executive branch that makes the law. This is another example of the anti-democracy nature of the Biden regime.

This is what a dictator does, usurps the legislative powers and seizes them for his own. That is how Adolf Hitler converted the Weimar Republic into the Third Reich, and it is what we are seeing Biden do almost daily in America these days on a wide variety of subjects.

What is even worse here is that Biden has taken an issue that Congress considered and rejected but he goes around Congress and tries to impose it anyway by himself. The risk of dictatorship in America comes from Biden, not Trump.

The gun transfers that Biden is trying to punish are usually between family members or friends. Criminals are not going to participate in any such background check arrangement anyway. If a criminal or other evildoer wants a gun, they are probably going to go down to the local open air drug block, where guns are often being sold, too, often with the serial numbers filed off. Punishing family members and friends transfering a gun will not do anything to stop those criminal gun markets.
