US Supreme Court strikes down race based gerrymandering in Congresional seats | Eastern NC Now

reverses activist Obama judge in Louisiana

ENCNow

In a landmark 6 to 3 decision, the US Supreme Court has driven a stake through the heart of race based jerrymandering.  In a case from Louisiana, it overturned the actions of a rogue Obama judge who had ordered the creation of a convoluted majority black district simply because it was possible to draw one.

Writing for the majority, Justice Alito wrote that "Section 2 of the Voting Rights Act of 1965 was designed to enforce the Constitution, not collide with it."  He added "sometimes lower courts have have applied this court's section 2 precedents in a way that sometimes forces states to engage in the very race based discrimination that the Constitution forbids."

Racial gerrymandering has created at least 12, and by some analysis as many as 20 gerrymandered safe Democrat seats mosly in southern states.  Many of those states have geared up to draw new districts after this expected SCOTUS outcome. The court ruling itself will reject Louisiana's racial gerrymander, eliminating one gerrymandered House seat held be a Democrat.

The first state out the gate is Florida which within hours of the ruling passed new maps that eliminate the racial gerrymandering in its congressional districts, as well as reflecting new population numbers.  Other southern state have also geared up to correct their district maps.

Last year, the 5th Circuit Court of Appeals in a Texas case outlawed the supposed requirement to draw districts where two or more majorities combined made up a majority of voters.  The Supreme Court had put its stamp of approval on that ruling be refusing to consider an appeal.  The Texas legislature responded by redrawing its map to eliminate five of those gerrymandered districts and the Democrats howled like stuck pigs.
