The US Fifth Circuit Court of Appeals has upheld a Texas state law that makes illegal immigration a state crime, which can be punished by state authorities.  The legislation allows a state judicial official to not only fine and jail an illegal alien but also to issue an order of removal back to his home country.  It allows a state court to take these actions even if federal immigration proceedings are pending.

The Court of Appeals overruled an Obama judge of the district court, who had ruled against the Texas law.

More states ought to enact similar laws.  Florida has already passed one, that has also been challenged in the courts.
