Where Does Roy Cooper Stand On President Obama's Nationwide School Bathroom And Locker Room Mandate? | Eastern North Carolina Now

Press Release:

NCGOP Launches Cooper Position Tracker To Hold Him Accountable

Raleigh, N.C — In an aggressive effort to hold Roy Cooper accountable, the North Carolina Republican Party (NCGOP) today launched a website to track Roy Cooper's positions on the issues facing North Carolinians. The tracker will also identify the many issues he has purposely dodged since launching his campaign for governor. Amid confusion among school officials over whether to follow federal or state law, NCGOP Chairman Robin Hayes also called on Roy Cooper to break his silence on President Obama's school bathroom and locker room mandate.

"Roy Cooper must do his job, period," said NCGOP Chairman Robin Hayes. "The President of the United States is pushing a radical new policy for bathrooms and locker rooms in our schools and our attorney general has yet to say publicly whether he supports this new policy or not."

As North Carolina's attorney general and chief law enforcement officer, Roy Cooper is charged with advising government officials on how to enforce and follow the law, especially when situations arise where there is ambiguity and confusion over various interpretations of the law.

State law now requires children in schools to use the restroom or locker room corresponding to their biological sex, while allowing schools to provide alternative accommodations for students with special circumstances. However, the Obama administration sent guidelines based on a new interpretation of federal law to all North Carolina schools saying that schools must allow students to use the restroom of their choice — a move that's in direct conflict with state law. If schools do not comply with the Obama administration's interpretation of the law, schools could face the loss of federal funding.

According to McClatchy, North Carolina's Democrat Superintendent of Public Instruction, June Atkinson, recently said that North Carolina schools should not follow state law. It has been reported that school districts have various interpretations about what to do as well, including in Wake and Durham counties:

  • "For example, in Wake County schools, some transgender students are able to use the bathroom that matches their gender identity — despite North Carolina's bathroom law, HB2, banning such a practice." ("Anna Douglas, "Federal bathroom directive highlights conflicting HB2 compliance in NC schools," McClatchy, 5/12/2016)
  • "The Durham Public Schools District makes accommodations for transgender students, but says it is not going to follow the federal directive." (Elaina Athans, "Reaction Swift To Obama School LGBT Bathroom Directive," ABC11, 5/14/2016)

Despite his obligation to advise North Carolina officials on how to follow and enforce the law, Roy Cooper's official website shows that he hasn't issued a legal opinion since 2010.

Should Americans be thankful for North Carolinians setting precedent in taking a stand for their state's right to manage the safety of their public facilities, where separation of the sexes remains, or should they follow Bruce Springsteen's lead and boycott the state as bigots since they will not allow grown Transgender men to use the same bathrooms /locker rooms as pre-pubescent girls?
North Carolina is right to control the separation of the sexes as a matter of decorum and safety.
North Carolina is a bigoted state to not require that children of opposite sexes share the same public facilities with adults of the opposite sex, although misidentified - the Transgender.
I generally prefer the natural environs of the vacant, although rather public, large tree.
