In 2023, a three judge panel of federal judges ordered the racial gerrymandering of Alabama's congressional districts, throwing out the districts drawn under Constitutional principles by the Alabama legislature. They did so on the argument that Alabama needed two black majority districts so blacks would have about the same proportion of members of congress as their overall statewide population. There was already one majority black district and to draw a second, they had to draw a convoluted crazy-quilt diestrict that was some of the most blatant racial gerrymandering possible.
That district and that thinking was clearly contrary to the Supreme Court recent ruling in a landmark Louisiana case. Yet, when the Alabama Attorney General presented that issue to them, the 3 judge panel tried to protect their unconstitutional racial gerrymander. Alabama asked to go back to the maps that had been properly adopted by the legislature in 2021.
The three arrogant Alabama federal judges claimed that using proper maps would cause "confusion" and therefore ordered their racial gerrymander to be used for the 2026 election. The Alabama Attorney General has appealed for an emergency order from the SCOTUS to overrule these arrogant Alabama federal judges so that voters will have a proper Constitutional set of congressional districts for this year's election.
The Civil Rights Division of the US Justice Department is siding with Alabama.
Meanwhile, the Louisiana state House has approved a new congressional map that eliminates the racially gerrymandered district.
