Thing That Make Noise in the Night, Part XI

Some times we know what those night noises are and sometimes we don't. Last week we did not know what the noise was when we first heard the thump. Now we know it was Chief Justice of the Supreme Court, John Roberts. It was a surprise to hear him in the quiet mystery of darkness. We will hear him again and again, maybe for the next 25 or 30 years, until his retirement. We thought we knew John Roberts, having been assured he was a clear and intelligent, conservative thinker. We never knew his dark side until that night.

Like many politicians (yes politicians) Roberts has found comfort, security and cover for his liberal character in the make up of the Court. There were usually five justices to vote liberal and it was easy for him to function as a minority conservative. He was under cover because the wining side had to write the opinions and explain why they ruled as they did. He had no reason to vote to make those decisions six to three. He had the sympathy of a minority conservative. Five liberal votes to four conservative votes was just as an effective win as six to three. Many elected officials play this deceitful game to maintain their political image.

By now you are asking "What makes Richardson so sure about this?" Because behavior speaks much louder than words, I am judging Roberts on what he has actually done. During this Supreme Court term Obama Care and the Arizona Immigration law were the two most important issues for conservatives. Roberts cast the deciding liberal vote on both issues.

Justice Hagan, appointed by Obama, did not sit for the Arizona case because she was the Chief Solicitor for the Government in trying to knock down the Arizona law. Now there are eight justices. Based on Roberts conservatisim the vote should have been four to four. A tie vote means nothing happens. The Arizona law would have stood. Roberts could have crossed over to fine tune the law on a few minor issues with out risking anything. He did not do that. He helped knock the entire law down. He did leave in the part about asking for documents. He gave us nothing with that. There is a lot of existing law about asking for documents. To have made even the smallest change would have caused serious problems with all Federal and state law enforcement and regulatory activities.

True liberals, because they are unprincipled, only want to win. The lack of principles leaves them with nothing but the glow of being right. In order to win Roberts voted with the liberals. Cover was provided to this liberal by court operating procedures. Roberts was never in the position of having to write an opinion on liberal issues. The winner writes the decision. Writing a decenting opinion is voluntary. This liberal mole had cover. To add insult to injury, Roberts tried to explain himself in the courts written decision. He was still looking for cover. He did not fool me.

My proof that Roberts is a closet liberal is that, like all liberals , he will make the sacrifice to expose himself only when there is no other way. He had to do it two times in this session of the court. You can expect Roberts to vote with the conservative members of the court until this liberal supreme court justice mole is needed again.
