Joshua Lawson, a registered voter and resident of Wake County, submitted a rulemaking petition to the State Board of Elections on March 26, 2021. The petition requested that the State Board amend 08 NCAC 06B .0103 to include the word "Nominee" after the candidate's name and party designation, and to include "Unaffiliated Candidate" after the candidate's name when a candidate qualifies by petition to run unaffiliated.

Separate from the rulemaking petition, the State Board is proposing several other changes to simplify the rule and to clarify the order of offices to be listed on the ballot.
