Diane Rufino Explains Nullification | Eastern North Carolina Now

And begs a slight indulgence that you sign her petition

The Constitution was established to provide limited centralized government. It was established as an "agent" or servant of the States. It was to serve the common interests of the States so that they can act like a "Union" of states and not 13 independent states. But the servant became the master -- not by force, but by stealth. It happened over many years as elected officials lost sight of the goals of the Constitution an un-engaged citizenry forgot that it was THEIR document. They forgot the pivotal role that the Constitution plays in securing their fundamental rights.

George Washington warned: "Government is not reason; it is not eloquent; it is force. Like fire, it is a dangerous servant and a fearful master." He was trying to warn us of the danger of allowing the government to extend beyond its constitutional boundaries.

In fact, our Founding Fathers and those who ratified the Constitution in their state conventions, gave us plenty of warning as to the dangers of a centralized government.

In his opening speech at the Virginia Ratifying Convention in 1788, Patrick Henry warned: "A wrong step now will plunge us into misery and our republic will be lost." He pleaded: "Liberty is the greatest of all earthly blessings. Give us that precious jewel and you may take everything else. There was a time when every pulse of my heart beat for American liberty and which, I believe, had a counterpart in the breast of every true American." He went on to urge his fellow delegates to regard the Constitution with suspicion and caution. He feared it might lead to too much government power, at the expense of the States, thereby negating the reason for the American Revolution.

Leadership in the NC General Assembly believes that blind obedience to the federal government we have no business second-guessing what the federal government does. They think that the Supremacy Clause protects every piece of legislation that comes out of Washington.

A mindset like this is the surest way for individuals to end up in chains, in detention camps, or even in concentration camps. Imagine we have a president like Adolf Hitler. Would we, the People of North Carolina, want our state officials to stand up to him or would we want them to lay down quietly as the SS comes into our state and destroys everything that defines North Carolina and makes us unique creatures endowed with inalienable rights.

That is why it's time for the People to revive Thomas Jefferson's doctrine of Nullification. It's a constitutional concept whose time has finally come. Nullification, as articulated by Jefferson, is a legal theory that says that a state has the right to nullify, or invalidate, any federal law which it deems to be unconstitutional. The theory of nullification is based on the very nature of the Constitution. It is based on the law of compact (or contract). It is based on the fact that the States formed the Union by an agreement (or "compact") among the States, and that as creators of the federal government, the States have the final authority to determine the limits of the power of that government. Under this compact theory, the States and not the federal courts are the ultimate interpreters of the extent of the federal government's power. If a state believes the federal government has exceeded its bounds of authority under the Constitution, it has the right - and perhaps even the duty - to say so. (A law that exceeds authority is null and void from its inception). Then the state should announce that it is unenforceable within its borders.

Nullification is constitutional because of the Supremacy Clause, in combination with the Tenth Amendment. The Supremacy Clause (Article VI, Section 2) announces that the "Constitution, and the Laws of the US which shall be made in pursuance thereof, shall be the supreme law of the land; and the judges in every state shall be bound thereby.." The Tenth Amendment states that "the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Taken in combination, we see the true nature of the Constitution... Those laws made pursuant to the express powers the States agreed to delegate to the federal government are supreme, but any law made in abuse of such powers has no force of supreme law because in fact, the federal government invaded a sphere of power that the States had reserved for themselves.

Please get involved in the Nullification Movement in North Carolina and get educated on this "Rightful Remedy" to limit the size and scope of the federal government and get us back to the days when we can truly enjoy our rights to Life, Liberty, and Property.
