law uses common carrier doctrine to stop big tech censorship of speech

ENCNow

The 5th Circuit US Court of Appeals has unanimously upheld Texas' law prohibiting censorship of posts on social media by the Big Tech companies like Facebook.   The Texas law deems the Big Tech companies to be common carriers and uses common carrier law to prohibit them from censoring the posted content of their users.  The Appeals court reversed a lower court opinion that had struck down the law.

Florida's anti-censorship law,. which did not operate on the common carrier theory was previously struck down.

An anti-censorship law is going through the Polish parliament that would require social media to allow a Polish citizen to post anything that was not in violation of Polish law.  If a Big Tech company censored it, a special court could act quickly to order the Big Tech company to restore the post, and if it refused to follow the order, could fine the Big Tech company a million euros per incident.
